Electronic Signature Of Policy
From time to time, Safe Auto may provide you with certain written notices or disclosures. The federal Electronic Signatures in Global and National Commerce Act (“ESIGN Act”) and certain state laws allow the use of electronic signatures. With your consent, you can review and sign your documents through the DocuSign, Inc. (DocuSign) electronic signing system. If you elect to electronically sign documents, further disclosures pertaining to electronic records and electronic signatures will be provided to you upon accessing a DocuSign link sent by Safe Auto.
Electronic Delivery Of Documents
Safe Auto may provide you with certain written notices or disclosures. Some of these notices and disclosures are required by law to be “in writing”, which means you are entitled to receive the notice or disclosure on paper. The federal ESIGN Act and certain state laws allow Safe Auto to provide you these notices or disclosures electronically with your consent.
Described below are the terms and conditions for providing such notices and disclosures to you in electronic form. Safe Auto reserves the right to provide you notices or disclosures in paper form, even if you have consented to receive the documents in electronic form. Please read the information below carefully; if you do not agree with any of the terms and conditions for electronic delivery, do not consent to electronic delivery. If you consent to electronic delivery of documents, you agree that this consent is voluntary and can be withdrawn at any time. You should print or otherwise retain a copy of this disclosure for your records.
All Notices And Disclosures Will Be Sent Electronically
Unless you tell Safe Auto otherwise, in accordance with the procedures described below, Safe Auto will provide to you in electronic format all required notices, disclosures, authorizations, acknowledgements, information, and other documents (collectively referred to as “electronic documents”) that are to be provided or made available to you. All electronic documents will be sent to the email address that you have provided to Safe Auto. However, as indicated above, Safe Auto reserves the right to provide you documents in paper form, even if you have consented to receive in electronic form.
How To Request A Paper Copy Of An Electronic Document
You will have the ability to download and print electronic documents that Safe Auto sends you. To request a paper copy of the electronic document, send an email to the appropriate email address designated below and include within your email your full name, email address, US Postal address, and telephone number. Safe Auto will at that time, if allowed by law, bill you for any fees associated with this request.

You may also call 1-800-SAFEAUTO (800-723-3288) and request a paper copy of an electronic document previously provided to you. Safe Auto will at that time, if allowed by law, bill you for any fees associated with this request.
How To Withdraw Your Consent For Electronic Delivery Of Documents
At any time, you may change your mind and request all electronic documents be in paper form and mailed to your US postal address on file with Safe Auto. To stop receiving electronic documents, send an email to customerservice@safeauto.com and include within your email your full name, email address, US Postal Address, and telephone number. Safe Auto does not require any other information from you to withdraw consent.
Withdrawing your consent will not affect the legal enforceability of electronic documents provided to you before the effective date of cancellation.
Consequences Of Withdrawing Your Consent
If you elect to receive required notices and disclosures in paper form instead of electronic form, it will slow the speed at which Safe Auto can complete certain steps in transactions with you and deliver services to you. The process will take longer because Safe Auto needs to send the required notices or disclosures to you in paper form and then wait for acknowledgment from you that you received such paper notices or disclosures.
To Advise Safe Auto Of Your New Email Address
It is your sole responsibility to keep your email address current, active, and capable of receiving emails. You are responsible for accessing, opening, and reading the electronic documents. The electronic documents have the same legal effect as printed ones.
To inform Safe Auto of any change to your email address for the electronic delivery of documents, send an email to customerservice@safeauto.com and include in your email both your previous email address and your new email address. Safe Auto does not require any other information from you to change your email address.
Safe Auto does not warrant that the delivery of electronic documents will be uninterrupted or error free. Further, Safe Auto is not responsible for problems arising from emails sent to an inactive or out-of-date email addresses. If an email is returned to Safe Auto as undeliverable, Safe Auto will attempt to resend the email. If the email is returned again as undeliverable, Safe Auto will presume that you have withdrawn your consent and the documents will be mailed to you using the US Postal address on file with Safe Auto.

If Safe Auto’s hardware or software requirements change and that change would create a material risk that you would not be able to access or retain your electronic records, Safe Auto will provide you notice of the revised hardware or software requirements. Continuing to accept electronic delivery of the documents after receiving notice of the change is reaffirmation of your consent.
State Specific Notices
The following notifications are required by law in the states identified below. Such notifications are applicable only to the residents of the identified states, and this Terms of Use remains in full force and effect, subject only to the modifications required by such notifications.
GEORGIA RESIDENTS – PLEASE READ THE FOLLOWING
Georgia law requires the following language be included in this Terms of Use:
"I AGREE TO RECEIVE ALL MAILINGS AND COMMUNICATIONS ELECTRONICALLY. SUCH ELECTRONIC MAILING OR COMMUNICATIONS MAY EVEN INCLUDE CANCELLATION OR NONRENEWAL NOTICES."
KENTUCKY RESIDENTS – PLEASE READ THE FOLLOWING
Kentucky law requires the following language be included in this Terms of Use:
"THE POLICYHOLDER WHO ELECTS TO ALLOW FOR THIS POLICY, NOTICES AND COMMUNICATIONS TO BE SENT TO THE ELECTRONIC MAIL ADDRESS PROVIDED BY THE POLICYHOLDER SHOULD BE AWARE THAT THE ELECTION OPERATES AS CONSENT BY THE POLICYHOLDER FOR ALL NOTICES TO BE SENT ELECTRONICALLY, INCLUDING NOTICE OF NONRENEWAL AND CANCELLATION. THEREFORE, THE POLICYHOLDER SHOULD BE DILIGENT IN UPDATING THE ELECTRONIC MAIL ADDRESS PROVIDED TO THE INSURER IN THE EVENT THAT THE ADDRESS SHOULD CHANGE."
Kentucky law also requires that you be advised of the options when electing to receive a policy and notices. The options are as follows: (1) You may continue to receive delivery of the policy and all notices in hard copy; (2) You may receive delivery of the policy electronically, but receive all notices in hard copy; or (3) You may receive delivery of the policy and all notices electronically.
TENNESSEE RESIDENTS – PLEASE READ THE FOLLOWING
Tennessee law requires the following language be included in this Terms of Use:
"THE POLICYHOLDER ELECTING TO ALLOW FOR NOTICES AND COMMUNICATIONS TO BE SENT TO THE ELECTRONIC MAIL ADDRESS PROVIDED BY THE POLICYHOLDER SHOULD BE AWARE THAT THE INSURER RIGHTFULLY CONSIDERS THIS ELECTION TO BE CONSENT BY THE POLICYHOLDER THAT ALL NOTICES MAY BE SENT ELECTRONICALLY, INCLUDING NOTICE OF NONRENEWAL AND NOTICE OF CANCELLATION. THEREFORE THE POLICYHOLDER SHOULD BE DILIGENT IN UPDATING THE ELECTRONIC MAIL ADDRESS PROVIDED TO THE INSURER IN THE EVENT THAT THE ADDRESS SHOULD CHANGE."
Federal Law
You acknowledge and agree that this consent for electronic delivery is being provided by you in connection with a transaction affecting interstate commerce and subject to the federal ESIGN Act, and that you intend that the Act apply to the fullest extent possible to validate your ability to conduct business with Safe Auto by electronic means.
Acknowledging your access and consent to receive materials electronically In agreeing to accept electronic delivery of documents, you are agreeing that:
- You have voluntarily agreed to accept electronic delivery of documents; and
- You have read and agreed to the Terms and Conditions for electronic delivery of documents; and
- You have the ability to print the Terms and Conditions and/or store the Terms and Conditions for future reference and access; and
- You have an active email address on file with Safe Auto and confirm that you have the required hardware and software described above; and
- If you are a resident of Georgia, Kentucky, or Tennessee, you have read the mandatory notification required by your respective state; and

Safe Auto may terminate this agreement at any time and without notice to you if, in Safe Auto’s sole judgment, you breach any term or condition of this agreement. Upon termination, you must destroy any and all materials you have obtained from the Safe Auto website.
Jurisdiction
These terms and conditions and the agreement they create, shall be governed by and interpreted according to the laws of the State of Ohio, without giving effect to Ohio's conflict of laws principles. Any dispute concerning this site shall be subject to the exclusive venue of a court of competent jurisdiction in Franklin County, Ohio.
Enforceability
If any provision of this agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions of this agreement shall remain in full force and effect and shall in no way be affected, impaired, or invalidated.
